Responding to ICE Officials

What should I do if officials from Immigration and Customs Enforcement (ICE) or any other police agency come to my home?

You are lawfully within the U.S., and you have certain rights under the law and constitution.  You should first ask the official to see his identification badge and, secondly, inquire if he has a warrant to show you.

You are not required to let any government official into your home without a warrant unless there is an emergency.

An example of an emergency is if someone within your home is in danger of harm. You are required to give the official your correct name and date of birth. Beyond that, you have a "right to remain silent." You are not required to volunteer any other information. Do not give any false information. You should calmly and politely state that you do not want to answer any questions until your attorney can be present. The official might say things like he will not be able to help you unless you help him. He may try to make you think you will get into trouble if you do not answer his questions.

You cannot get into trouble for remaining silent. This is your right.

To protect yourself, it is important that you do not speak with ICE or any other police officer unless you have a lawyer with you. Simply ask how to contact the officer, then consult with an attorney as soon as possible.

Resources can be found online, but Immigrant Defense Project is a non-profit organization who specializes in this. More information can be found on their website.
